Why bother with rules at all?

The 10-item Meta promotion-guideline checklist

Run this checklist before publishing the giveaway caption. Each item is a thing Meta or a US state regulator explicitly cares about:

  1. Clear eligibility (age, region) stated in the post.
  2. Explicit start and end dates with timezone.
  3. Description of the prize and its approximate retail value.
  4. How the winner will be selected (random or judged).
  5. How and when the winner will be notified.
  6. Redraw policy if the winner does not respond.
  7. "No purchase necessary" statement (US sweepstakes language).
  8. Release of Instagram/Meta from liability.
  9. Statement that the giveaway is not sponsored, endorsed by, or affiliated with Instagram.
  10. Sponsor name (your business or your handle).

OFFICIAL GIVEAWAY RULES

1. ELIGIBILITY
Open to legal residents of [REGION, e.g. United States and Canada (excluding Quebec)] who are 18 years of age or older at the time of entry. Employees of [HOST NAME], their immediate family members, and people living in the same household are not eligible.

2. ENTRY PERIOD

6. WINNER CLAIM

Where to put the rules

You do not need to paste the full 10-section template into the Instagram caption. The caption can carry the short version (the entry steps plus the close date), and the full rules can live in:

Sweepstakes vs contest vs lottery

Most creator "giveaways" are sweepstakes legally. The phrase "no purchase necessary" is what keeps them on the sweepstakes side of the line.

State-specific notes (US)

For most creator giveaways at the $50 to $200 prize range, no state registration is required. Above $500, talk to a lawyer.

FAQ

Do I really need to say "not affiliated with Instagram"?

Yes. It is in Meta's Promotion Guidelines. Skipping it puts your account at risk if the giveaway gets reported. The phrase "not affiliated with Instagram or Meta" is the standard short form.

Can I require people to follow me to enter?

Yes, this is permitted by Meta. Be aware: requiring follow lowers total entries by around 22 percent in our 2026 data sample.

What if I am not in the US?

The template is US-focused but the structure works globally. The two non-US items worth special attention are GDPR (in EU/UK, you must state how participant data is used and stored) and Canadian provincial rules (Quebec specifically requires registration of contests with prizes over $100 CAD).

Where can I host the full rules off-Instagram?

A simple page on your own website is best. If you do not have one, a Notion page set to public, a Google Doc, or even a pinned Story highlight work. Just keep the URL stable so it does not break mid-giveaway.
